ChatGPT compared to European AI assistants

ChatGPT is operated by OpenAI, a US company headquartered in San Francisco. Its infrastructure runs largely on Microsoft Azure in the United States. As a US provider, OpenAI is subject to the CLOUD Act (2018), which can enable the disclosure of data to US authorities even when it is stored outside the United States. The Schrems II ruling (2020) found that US surveillance laws conflict with the GDPR.

By default, ChatGPT uses conversations to improve its models unless users disable this in the settings. Different rules apply to the Team and Enterprise plans and the API, under which inputs are not used for training. Content entered, including sensitive business or health data, is processed and stored on servers in the United States. ChatGPT does not offer end-to-end encryption of chats.

The Italian data protection authority Garante ordered a temporary ban of ChatGPT in Italy in March 2023 and issued a 15 million euro fine in December 2024 for GDPR violations, including the lack of a legal basis for processing and insufficient age verification. For organisations with confidentiality obligations such as law firms, medical practices, research institutions or public agencies, processing data in the United States is an additional compliance factor.

The European providers cover different use cases. All three providers are subject to European data protection law. Mistral AI and Aleph Alpha are based in France and Germany and therefore directly within the scope of the GDPR.
